Wrongful death versus survival claims
A wrongful death claim compensates survivors for their own losses: financial support, services, companionship and guidance. A survival action belongs to the estate and recovers what the deceased could have claimed had they lived, including conscious pain and suffering before death. Most states allow both.
Who may file
Most states require the estate's personal representative to file on behalf of statutory beneficiaries, typically the spouse, children and parents. Some states allow family members to file directly. The statute of the state where the death occurred controls.
Deadlines
Wrongful death statutes of limitation are typically one to three years from the date of death, which can differ from the injury statute. Government defendants require earlier notice.
