What to do after a motorcycle accident in Palestine
- Get medical treatment immediately and document every injury, including road rash and bruising that may seem minor.
- Preserve your helmet, gear and the motorcycle; they are physical evidence of impact speed and direction.
- Photograph the scene, the other vehicle, your bike and your injuries, and find witnesses. Riders are often blamed unfairly, and independent witnesses correct that.
- Do not give a recorded statement to the other driver's insurer. Innocent phrasing is used to argue you were speeding or lane-splitting.
- Ask a lawyer to request traffic and business camera footage right away.
- Track all expenses, including gear replacement and modifications to your home or vehicle during recovery.
Texas law that controls a Palestine motorcycle accident claim
Texas generally gives injured people two years from the date of the injury to file a personal injury lawsuit in the Anderson County District Court. Miss that window and the court will almost always dismiss the case no matter how strong it is. Claims against a city, county or state agency usually have much shorter notice deadlines, sometimes only a few months.
Texas follows modified comparative negligence (51% bar), which means you can recover as long as you were not more than 50% at fault, and your award is reduced by your share of fault. Insurance adjusters know this rule well and routinely try to shift blame onto the injured person, so what you say in the first days after an accident in Palestine matters.
Texas uses a traditional fault-based auto insurance system. The at-fault driver's liability coverage is the primary source of compensation, and drivers are only required to carry minimum limits of 30/60/25 (bodily injury per person / per accident / property damage, in thousands). Serious injuries routinely exceed those limits, which is why underinsured motorist coverage and a careful search for every liable party matter so much.
Cases that cannot be settled are filed in the Anderson County District Court. Most motorcycle accidents in Anderson County resolve through negotiation with the insurer, but the credible ability to try the case locally is what produces fair offers.
Who can be held responsible for a motorcycle accident in Anderson County
- Drivers who fail to yield, turn left across a rider's path, change lanes without checking blind spots or follow too closely.
- Drivers who open car doors into traffic.
- Government entities responsible for potholes, loose gravel, unmarked road edges and faulty signals in Palestine.
- Motorcycle or parts manufacturers for defective tires, brakes or frames.
- Bars that over-served a drunk driver, where Texas law permits dram shop claims.
Evidence that wins these cases
- Police report and any citations for failure to yield.
- Helmet and gear damage analysis.
- Scene photos, gouge marks and debris fields that show speed and point of impact.
- Witness statements and video.
- Medical records, including documentation of permanent scarring or disability.
What compensation is available
Motorcycle accident compensation in Texas includes medical costs, future care, lost wages and earning capacity, motorcycle and gear replacement, and pain and suffering, which is typically substantial in rider cases because of the severity of the injuries. Riders with underinsured motorist coverage on their motorcycle policy can also claim against it when the driver's 30/60/25 minimum policy is not enough.
Frequently asked questions
Does not wearing a helmet hurt my motorcycle accident claim in Texas?
It can be raised to argue you contributed to head injuries, depending on Texas's helmet law and comparative fault rule (modified comparative negligence (51% bar)). It never excuses the driver who caused the crash, and it is irrelevant to injuries below the neck.
How long do I have to sue after a motorcycle crash in Palestine?
Generally two years under Texas's personal injury statute of limitations. Claims involving road defects maintained by a public entity have much shorter notice requirements.
The driver says they "didn't see me." Is that a defense?
No. Failing to see a motorcycle that was there to be seen is the definition of negligence. It is the most common explanation in left-turn and lane-change crashes.
What is a motorcycle accident case worth in Anderson County?
Rider cases often involve fractures, surgeries, traumatic brain injuries and permanent scarring, so values are frequently higher than typical car accident claims. Available insurance and the clarity of fault are the other main drivers.
Do I pay anything upfront for a motorcycle accident lawyer?
Usually not. Motorcycle accident attorneys typically work on contingency, with fees paid only from a settlement or verdict; confirm the terms before hiring.
